Supreme Court upheld the notice of the IT department for recovery of Rs.1.66 crores for Amithab “Kaun Banega Karorpathi” T.V show. A bench of the Supreme court permitted an apeal of the IT department against Bombay High Court verdict confirming an order of the IT appellate Tribunal from exemption. The SC in its order said the notice issued by the IT department could not have been dropped on the ground that the claim was withdrawn.
The Court said ,”We, therefore, are of the opinion that the commissioners of IT was perfectly justified in comming to the conclusions and in passing the impugned order on that basis. The court commented that tribunal and High Court should not have interfered with the said conclusions. This is a fit case for exercise of the suo motu revisional powers of the CIT under section 263 of the act.”
“The order of the CIT is restrored and those of the tribunal dated 28-08-2007 and the High Court dated 28-08-2008 are set aside.”
